Multidisciplinary healthcare committees meet regularly to discuss patients’ candidacy for emerging functional neurosurgical procedures, such as Deep Brain Stimulation . Through debate and discussion around the surgical candidacy of particular patients, functional neurosurgery programs begin to mold practice and policy supported both by scientific evidence and clear value choices. These neurosurgical decisions have special considerations not found in non-neurologic committees. The professional time used to resolve these conflicts provides opportunities for the emergence of careful, ethical practices simultaneous with the expansion (...) of therapy applications. (shrink)

I argue that Kant’s mature political philosophy entails the provisionality thesis. The provisionality thesis asserts that in a world like ours, populated with beings sufficiently like us, acquired rights (rights to external objects of choice, including property, sovereignty and territory) are necessarily provisional. I motivate the standard view, which restricts the notion of provisional right to the state of nature and the transition from the state of nature to the civil condition. I then provide two textual arguments against it. There have been two recent attempts to disentangle the evidence for the procedures in fourth-century Athens for the enactment and revision of nomoi, by D. M. MacDowell and by M. H. Hansen. I have learned from both, but think that further progress can be made. MacDowell distinguishes five separate measures: The Old Legislation Law, requiring action at a specified time, advance publicity for the new proposal, concurrent repeal of any existing law with which the new proposal conflicts, and a decision (...) by nomothetae who are omomokotes, men who have sworn the dicastic oath : this is described as a παλαις νόμος, and as the law καθ' ν σαν ο πρότεροι νομοθέαι. Replacing that c. 370, the New Legislation Law, no longer requiring action at a specified time, advance publicity, concurrent repeal, or that the nomothetae should be omomokotes: as a result of the change conflicting laws have been enacted, and for some time continuing to the mid 350s commissioners have had to be elected to sort out the conflicts. Still valid in the 350s, the Review Law, requiring an annual epicheirotonia of the laws in four subject divisions in the assembly on 11 Hecatombaeon , advance publicity for new proposals, and at the third assembly after 11 Hecatombaeon the appointment of nomothetae who are omomokotes to decide between the existing laws and the new proposals. The rapid rise of international collaborative science has enabled access to genomic data. In this article, it is argued that to move beyond mapping genomic variation to understanding its role in complex disease aetiology and treatment will require extending data sharing for the purposes of clinical research translation and implementation.

One of the central arguments given to resist testing currently healthy, asymptomatic children for adult-onset diseases is that they may be psychologically harmed by the knowledge gained from such tests. In this discussion I examine two of the most serious arguments: children who are tested may face limited futures, and that testing may result in damage to the child’s self esteem . I claim that these arguments do not stand up to critical evaluation. In conclusion, whilst I do not suggest (...) that all at-risk children should be tested for adult-onset diseases we ought to listen carefully to some parental requests for such testing because the putative psychological harms may not be as significant or likely as initially thought. This is because parents generally have the best interests of their children at heart and if they are properly supported and educated about predictive genetic testing and the possible consequences, then the risk of psychological harms occurring may be ameliorated. Harrison in The Law of Athens, i , 63–5, argued that the exclusion of bastards from the phratries and the severe restriction of their right of inheritance does not entail their exclusion from Athenian citizenship; and that the form of Pericles' citizenship law, not stating that were to be , and Solon's law restricting the inheritance rights of , both point to the conclusion that bastards were not ipso facto debarred from citizenship. D. M. MacDowell in CQ (...) N.S. 26 , 88–91, rightly finds Harrison's positive arguments inconclusive, but suggests that three texts provide more definite support for this conclusion. (shrink)

Context The conduct of medical research led by Northern countries in developing countries raises ethical questions. The assessment of research protocols has to be twofold, with a first reading in the country of origin and a second one in the country where the research takes place. This reading should benefit from an independent local ethical review of protocols. Consequently, ethics committees for medical research are evolving in Africa. Objective To investigate the process of establishing ethics committees and their independence. Method (...) Descriptive study of 25 African countries and two North American countries. Data were recorded by questionnaire and interviews. Two visits of ethics committee meetings were conducted on the ground: over a period of 3 months in Kigali (Rwanda) and 2 months in Washington DC (USA). Results 22 countries participated in this study, 20 from Africa and two from North America. The response rate was 80%. 75% of local African committees developed into national ethics committees. During the last 5 years, these national committees have grown on a structural level. The circumstances of creation and the general context of underdevelopment remain the major challenges in Africa. Their independence could not be ensured without continuous training and efficient funding mechanisms. Institutional ethics committees are well established in USA and in Canada, whereas ethics committees in North America are weakened by the institutional affiliation of their members. Conclusion The process of establishing ethics committees could affect their functioning and compromise their independence in some African countries and in North America. (shrink)

Contractarians aim to derive moral principles from the dictates of instrumental rationality alone. But it is well-known that contractarian moral theories struggle to identify normative principles that are both uniquely rational and morally compelling. Michael Moehler's recent book, *Minimal Morality* seeks to avoid these difficulties by developing a novel "two-level" social contract theory, which restricts the scope of contractarian morality to cases of deep and persistent moral disagreement. Yet Moehler remains ambitious, arguing that a restricted version of Kant's categorical imperative (...) is a uniquely rational principle of conflict resolution. We develop a formal model of Moehler's informal game-theoretic argument, which reconstructs a valid argument for Moehler's conclusion. This model, in turn, enables us to expose how a successful argument for Moehler's contractarian principle rests on assumptions that can only be justified by subtle yet significant departures from the standard conception of rationality. We thus extend our understanding of familiar contractarian difficulties by showing how they arise even if we restrict the scope of contractarian morality to a domain where its application seems both promising and necessary. We show that the problem lies not in contractarians' immodest ambitions but in the modest resources rationality can offer to satisfy them. (shrink)

First published in 1972, the series continues to attract widespread interest. In this volume, contributors argue about the mind from diverse analytical standpoints. The focus of the series remains the relationship between religion, science, and philosophy. This volume attempts to (...) achieve a comprehensive view of the subject of mind. The mental development of children in the light of modern psychology is discussed, and the distinction between "how" and "why" questions is put forward with clarity. The development of mind is further contrasted with the evolution of embryos in the young. The mind is considered as a capacity for intellectual activity, and as a multi-purpose program. Goal-directed behavior and language development are given importance, and issues of cosmic purpose, and the how and why of evolution, are never far from the surface of the argument. The lecturers know their opposition and their positions, and the cut-and-thrust of the discussion has much acumen and wit to it. We isolate two abstract determinacy theorems for games of length $\omega_1$ from work of Neeman and use them to conclude, from large-cardinal assumptions and an iterability hypothesis in the region of measurable Woodin cardinals thatif the Continuum Hypothesis holds, then all games of length $\omega_1$ which are provably $\Delta_1$ -definable from a universally Baire parameter are determined;all games of length $\omega_1$ with payoff constructible relative to the play are determined; andif the Continuum Hypothesis holds, then there is a model of (...) ${\mathsf{ZFC}}$ containing all reals in which all games of length $\omega_1$ definable from real and ordinal parameters are determined. Takeuti introduced an infinitary proof system for determinate logic and showed that for transitive models of Zermelo-Fraenkel set theory with the Axiom of Dependent Choice that contain all reals, the cut-elimination theorem is equivalent to the Axiom of Determinacy, and in particular contradicts the Axiom of Choice. We consider variants of Takeuti's theorem without assuming the failure of the Axiom of Choice. For instance, we show that if one removes atomic formulae of infinite arity from the language of Takeuti's proof (...) system, then cut elimination is equivalent to a determinacy hypothesis provable, e.g., in ZFC + “there are infinitely many Woodin cardinals.” A slight extension of the proof system admits cut elimination for countable sequents under the same assumptions. A simple modification of the proof system yields analogs of the results above for the Axiom of Real Determinacy and uncountably many Woodin cardinals. (shrink)

It is shown that the determinacy of $G_{\delta \sigma }$ games of length $\omega ^2$ is equivalent to the existence of a transitive model of ${\mathsf {KP}} + {\mathsf {AD}} + \Pi _1\textrm {-MI}_{\mathbb {R}}$ containing $\mathbb {R}$. Here, $\Pi _1\textrm {-MI}_{\mathbb {R}}$ is the axiom asserting that every monotone $\Pi _1$ operator on the real numbers has an inductive fixpoint.

We characterize the determinacy of $F_\sigma $ games of length $\omega ^2$ in terms of determinacy assertions for short games. Specifically, we show that $F_\sigma $ games of length $\omega ^2$ are determined if, and only if, there is a transitive model of ${\mathsf {KP}}+{\mathsf {AD}}$ containing $\mathbb {R}$ and reflecting $\Pi _1$ facts about the next admissible set.As a consequence, one obtains that, over the base theory ${\mathsf {KP}} + {\mathsf {DC}} + ``\mathbb {R}$ exists,” determinacy for $F_\sigma $ (...) games of length $\omega ^2$ is stronger than ${\mathsf {AD}}$, but weaker than ${\mathsf {AD}} + \Sigma _1$ -separation. Using covariant derivatives and the operator definitions of quantum mechanics, gauge invariant Proca and Lehnert equations are derived and the Lorenz condition is eliminated in U(1) invariant electrodynamics. It is shown that the structure of the gauge invariant Lehnert equation is the same in an O(3) invariant theory of electrodynamics.
